Guidelines for Handling Third-Party Caskets

Because the Federal Trade Commission (FTC) Funeral Rule does not specifically address many of the issues surrounding third-party merchandise, NFDA has prepared guidelines for funeral directors to follow. Guidelines for Handling Third-Party Caskets, written by T. Scott Gilligan, NFDA's general counsel, provides these guidelines as well as standards for pricing practices regarding third-party merchandise. The article discusses specifically what funeral directors should do when a family wishes to use a third-party casket and when dealing with third-party casket suppliers. Gilligan is a partner with the law firm of Kepley, Gilligan & Eyrich in Cincinnati, OH, and represents NFDA in matters dealing with the FTC Funeral Rule.
