Supreme Court Limits Scope of the Americans With Disabilities Act
In a recent case, the U.S. Supreme Court placed important restrictions on the basic scope of the Americans with Disabilities Act (ADA). As a result, it is no longer sufficient for individuals attempting to prove disability status under the ADA to merely submit evidence of a medical diagnosis of an impairment. Rather, claimants are required to prove that their impairment substantially limits their ability to perform one or more major life activities.
For details about this case, read Supreme Court Limits Scope of the Americans with Disabilities Act, written by NFDA general counsel T. Scott Gilligan. Gilligan is a partner with the law firm of Statman, Harris, Siegel & Eyrich in Cincinnati, Ohio.
