The legal aspects of handling Creutzfeldt-Jakob disease cases

Written by T. Scott Gilligan

In its July 2000 issue, The Director published an article, A CJD Primer, by James Burnside, Curtis Rostad and Kurt Soffe, which provided a detailed analysis of Creutzfeldt-Jakob disease (CJD) and the practical risks it presents for funeral home and embalming personnel. ADA/CJD‹The legal aspects of handling Creutzfeldt-Jakob disease cases is a follow-up article that examines the legal responsibilities of funeral homes to families of CJD victims and to the public. It addresses the funeral home's obligations to the family under the Americans with Disabilities Act (ADA) and its common-law duty not to expose members of the public to health risks. The article was written by T. Scott Gilligan, a partner with the law firm of Kepley, Gilligan & Eyrich in Cincinnati, OH. Gilligan serves as NFDA general counsel and represents NFDA in matters dealing with the FTC Funeral Rule.
